Abstract

Trademark right is an important part of intellectual property system, and also an economic right for market participants to participate in market transactions in an orderly manner. Since the introduction of Trademark Law in 2013, there have been many attempts and divergences in theory and judicial practice. This paper introduces from the overview of the trademark first use right system, analyzes and expounds the main body, object and time requirements of the system, and introduces typical judicial cases, and puts forward the viewpoints of insight. In order to provide reference for the understanding and application of the trademark first use right system.
