Abstract
With the rapid development of artificial intelligence (AI) technology, the application of Artificial Intelligence Generated Content (AIGC) in fields such as news writing and artistic creation has become increasingly widespread, making the issue of its intellectual property (IP) ownership a pressing legal challenge. This paper begins with the research background and significance, analyzes the challenges posed by AIGC to the traditional IP system, sorts out the domestic and international research status and existing deficiencies, discusses the definition and characteristics of AIGC, the main viewpoints and controversial focuses on IP ownership, and combines typical judicial cases such as the "AI text-to-image" copyright infringement case to analyze the legal risks in the determination of AIGC's IP ownership. Finally, it proposes countermeasures to improve IP ownership from the aspects of rights subject division, originality judgment criteria, tort liability allocation, and international rule coordination. The study shows that the IP regulation of AIGC requires seeking a dynamic balance between technological innovation and legal order, constructing a multi-level governance system with the "human contribution degree" as the core, and promoting the innovative development of IP legal theory and practice to adapt to the needs of the AI era.
