Abstract

Since the Interpretation of Several Questions Concerning the Application of Law in Criminal Cases of Illegal and Destructive Mining issued jointly by the Supreme People's Court and the Supreme People's Procuratorate in 2016, the crime of illegal mining has been convicted and sentenced for serious illegal mining, which has increased the intensity and power of cracking down on illegal mining. However, due to the short execution time of “two high” judicial interpretation and the lack of accumulated experience, there are still many problems and difficulties in the collection of evidence and the application of law in the case of sand mining. The article analyses these problems and puts forward corresponding countermeasures and measures.
